Attention all REALTORS® – Brampton sign By-Law Amendment

To amend By-law 399-2002, as amended,

The Sign By-law

WHEREAS the current provision of the Sign By-law pertaining to Open House Directional Signs was adopted in 2005; and

WHEREAS a revised setback from the roadway will provide more flexibility for the placement of real estate open house signs resulting in greater visibility of the signs to passers-by; and

WHEREAS for sale or lease signs on private property are primarily installed and removed by a third party hired by the real estate agent;

NOW THEREFORE The Council of the Corporation of the City ofBrampton ENACTS as follows.

THAT By-law 399-2002, as amended, is hereby further amended:

1)    By replacing the following sentence to Section 9 EXEMPTIONS FOR SIGNS ON A ROAD RIGHT-OF-WAY:

(9)        Open House Directional Signs, provided that:

(a)      The signs shall be placed only during the hours of the open house;

(b)      No sign shall be located on a centre median of a roadway;

(c)      The signs shall be located a minimum distance of 1 m (3.3 ft) from the curb, asphalt or gravel shoulder of a roadway;

(d)      The signs shall be located a minimum distance of 0.3 m (1 ft) from a sidewalk; and

(e)      The signs shall consist of A-frame signs not exceeding 0.35 m2 (3.75 ft2) in sign area and 0.6 m (2 ft) in height ; and

(f)       The signs shall not be located so as to obstruct or interfere with highway maintenance, impede movement of pedestrian or vehicular traffic, impede the use of utilities or bus stops or otherwise create a hazard

2)    By replacing the following sentence to Section 8 EXEMPTIONS:

(3)            A property for sale or lease sign provided that it is on the lot advertising for such purpose and does not exceed 1 m2 (10.8 ft2) in sign area and 1.5 m (4.9 ft) in height for a property zoned residential and 2 m2 (21.5 ft2) in sign area and 3.6 m (12 ft) in height for a property not zoned residential.  Only one for sale or lease sign shall be permitted for each lot and the sign shall be removed within one week after the property is no longer for sale or lease.

  2. We really have come a long way lately, Thanks BREB!
    For those of you who did not know, until recently you only had 48 hours after a property was sold in which to remove your sign, did most of you ever do it, not likely. You now have a week!! It is an improvement.
    As for the open house signs, lets face it, we did have a lot of silly people placing signs in the middle of intersections and one big gust of wind (like what we have been experiencing recently) and the sign could be blown right in to the path of on coming traffic, I know you would never do that, but some have. Simple, Keep Them Off The Roads – curb side where they belong and advertise your open house to be sure you get the traffic!
    PS : Builders pay hefty fees to put their signs out via permits and must still obey strict guidleines. Right now we are except from fees againthanks to our boards efforts with the by-law department.


  3. More restrictions. Soon we will need the city’s permission to sell a home. Some people just don’t like agents. This is really getting rediculous. What ever happened to free enterprise?


  4. When they start getting into fine measurements, it is starting to get ridiculous. 3.3 feet this and
    4.8 that, etc. etc.
    We need to start carrying our geometry kits and micrometers.
    It’s absolutely true about The Property Guys. There are two sets of rules in existence. The City of
    Brampton doesn’t realize how valuable we are as realtors!

    1. Hi Tony. I understand your frustration. But this new by-law is a huge improvement over what we had in the past. The reality is dimensions have existed in the by-law since it was introduced. The problem was that those dimensions were smaller than our signs, resulting in agents being fined and signs confiscated.

      The new by-law is a step in the right direction. We have built a cooperative relationship over the last 18mos with the City and we are at the table more often when it comes to decisions that impact our REALTORS(R).

  5. Another example of government interference in people trying to make an honest living in real estate. This is getting ridiculous. Soon agents will be leaving the business by the hundreds. There are too many restrictions on real estate agents. Many for silly reasons or to satisfy the few out there that have problems with the real estate industry. There is an underlying stereotypical prejudice toward the real estate agent here. Open house signs are not a safety hazard. They don’t jump up and attack people. Brampton city council should be spending its time on more important issues than open house attack signs.


    1. Just curious. Where do you get these ” Open House Attack Signs ” ?
      Do they work?
      Do they really attack?
      Do we have to worry about Melanie Aitken THE COMMISSINER OF COMPETITION at The Competition Bureau
      We should run it by her office. You make sure we give everyone a kick.


    2. Roll on the time when agents are leaving this business by the hundreds, can’t wait, especially if it means more business for those of us who are left! I agree there are a lot of restrictions on realtors but many are brought about by bad judgement on the part of agents! Example; Open house signs can be a safety hazzard, especially when placed inappropriately in centre islands.Sorry Lou but one big gust of wind and before you know it they are up in the air and flying in to traffic. I have witnessed it on Kennedy Rd at Sandalwood and on Conestoga at Fanshawe at the turn by the bus station where there is a bit of a wind trap.
      We all really have to be responsible when placing our signs and pick them up again when your finished!. Please, enough of the six week SOLD Campaigns. If you see a SOLD sign up for more than a couple of weeks (one week is the by-law) call the guy/gal and tell him/her to remove it, this blatent misuse of priviledge will have us all paying the price when they stop us using signs all together and/or make us pay for permits.


  6. Why is it that conpanies like Property Guys have signs placed at curb side by there clients, left for weeks and the biy-law officers never remove them. May I suggest we start calling the by-law office and make them aware of the infraction and location.


    1. Yes also privat for sale are all over the place in not appropriate places If we need to obey the law so should everyone else and they also should receive a penalty.Regina Lewis
